GDPR Rights Statement

At Wizbay, we respect your privacy and your rights over your personal data.

This page explains the rights you may have under the General Data Protection Regulation (GDPR) and how you can exercise those rights when you use the Wizbay platform, website, or services.

1. Your Rights

Under the GDPR, you may have the following rights in relation to your personal data.

Right to be informed

You have the right to know how we collect, use, store, share, and otherwise process your personal data. We explain this in our Privacy Policy, this page, and any other privacy notices we provide to you.

Right of access

You can ask us to confirm whether we process your personal data and, if we do, to give you access to it. You may also ask for more information about how we use it.

Right to correct your data

You can ask us to correct personal data that is inaccurate or incomplete.

Right to delete your data

You can ask us to delete your personal data in certain circumstances. This right does not always apply. For example, we may need to keep some data to comply with legal obligations, prevent fraud, resolve disputes, enforce our terms, or protect our legal rights.

Right to restrict how we use your data

You can ask us to limit how we use your personal data in certain situations. For example, you may ask us to restrict processing while we check whether the data is accurate or whether we are allowed to use it.

 

Right to data portability

In some cases, you can ask us to provide certain personal data you gave us in a structured, commonly used, and machine-readable format. You may also ask us to transfer it to another provider where technically possible.

Right to object

You can object to certain uses of your personal data where we rely on legitimate interests as our legal basis, if your particular situation gives you reason to object.

You can also object at any time if we use your personal data for direct marketing.

Right to withdraw consent

Where we rely on your consent to use your personal data, you can withdraw that consent at any time. This will not affect any processing we carried out lawfully before you withdrew your consent.

Rights related to automated decisions

You have the right not to be subject to a decision based only on automated processing, including profiling, if that decision produces legal effects concerning you or similarly significantly affects you, unless the law allows it and proper safeguards are in place.

2. How to Exercise Your Rights

If you want to exercise any of your rights, please contact us using the details below.

When you contact us, please give us enough information to:

  • identify you;

  • confirm that you are entitled to make the request; and

  • understand what you are asking for.

We may ask for additional information to verify your identity before we respond. This helps us protect your personal data and prevent unauthorised access.

3. How Long It Takes

We will respond to your request without undue delay and usually within one month.

If your request is particularly complex, or if we receive several requests from you, we may need more time. If that happens, we may extend the response time by up to two additional months, and we will let you know why.

4. Fees and Limits

You will not usually have to pay a fee to exercise your rights.

However, if a request is clearly unfounded, excessive, or repetitive, we may charge a reasonable fee or refuse to act on the request where the law allows us to do so.

Please also note that some rights only apply in certain situations and may be limited by law.

5. Wizbay’s Role and Third-Party Sellers

Wizbay is an online marketplace platform. This means that, depending on the situation, Wizbay may be responsible for some personal data processing, while third-party sellers may be responsible for other processing.

For example, Wizbay may process personal data for account management, platform operations, customer support, payment-related administration, fraud prevention, trust and safety, moderation, returns coordination, and legal compliance.

Third-party sellers may separately process personal data for their own purposes, such as fulfilling orders, handling after-sales support, warranties, invoicing, or meeting their own legal obligations.

Because of this, your request may sometimes need to be handled by Wizbay, by the relevant seller, or by both. Where appropriate, we may direct you to the relevant seller or coordinate with them.

6. AI-Assisted Tools

Wizbay may use automated and AI-assisted tools to help operate and improve the platform.

These tools may be used for purposes such as:

  • helping create or translate listings;

  • moderation and review screening;

  • fraud prevention;

  • image quality, authenticity, or clarity checks;

  • trust and safety functions; and

  • customer support assistance.

Wizbay does not use solely automated decision-making that produces legal or similarly significant effects on users, unless this is allowed by law and appropriate safeguards are in place.

7. Requests Made for Children

Where the law allows a parent or legal guardian to act for a child, we may ask for proof that the person making the request has the legal authority to do so.

8. Complaints

If you think we have not handled your personal data lawfully or have not properly dealt with your request, you have the right to complain to a data protection authority.
